As usual at the end of each year, we get ready to implement the changes required by new laws passed by our primarily anti-gun Kalifornia legislature. (If you wish to receive email notification of changes in the law, please send a blank email to subscribe@ARMUSA.com.)

The majority of new laws, passed under the guise of handgun safety, work more to prevent law-abiding citizens from owning firearms than anything else. While the purported goal is to promote firearm safety, additional gun control regulations confuse and burden the average citizen, many of whom choose NOT to make further firearm purchases. Some would rather forego buying guns altogether than put up with the B.S. we're forced to endure. All the while, you've got little POS gang bangers and criminals who steal guns or buy them on the black market and who will get theirs guns regardless of whatever gun laws are passed - NO 10 DAY WAIT, NO NOTHIN'. Don't get me started....

Highlights of new legislation taking effect January 1, 2003:

Handgun Safety Certificate: All purchasers must possess a valid HSC. The Hunter Safety Course and Hunting License exemptions no longer exist. Nor is an Honorable Discharge of any value. Military exemptions include only Active, Reserve, or Honorably RETIRED only. All other military must have a HSC. Exemptions still exist for law enforcement, peace officers, CCW permit holders, those with permits to carry exposed firearms, to name a few.

The new HSC can be obtained by taking a 30-question multiple choice test and obtaining a minimum passing score of 23. It is very similar to the last test that was offered for the BFSC. A video should be available in March 2003, but I do not believe you can watch the video to obtain the HSC. Any fourth grader should be able to pass this test as well, with a little common sense.

"So, what's the difference?" you ask? The difference is that now they get to stick you with the HSC fee every 5 years, rather than it being good forever. Over 10 years, that means twice as much money as they've been receiving under the BFSC program. The whole purpose of the new HSC requirement is to stick law abiding gun owners with another fee and to create more BS for us to go through to get a gun. Thankfully, we are hearing from a great deal of customers that the new law won't keep them from getting their guns. Hooray for you! And thank you! Gun stores can hardly survive if the shooting sports fade away.

Testing materials are now available. Keep in mind that we do NOT give the test to just anyone. Seriously, it doesn't take a rocket scientist to pass the test. At ARM USA, we have a higher standard. Before we will give you the test, you must have some type of firearm knowledge and hands-on experience. It is not enough just to pass a lousy 30-question test. No kidding, a fourth grader probably REALLY COULD pass these tests. If we do not feel comfortable putting a gun in your hands, then we will NOT give you the test. This is our prerogative. Sure, you could run over to some big chain store and say "Yeah, I need to take the test to buy a gun," and they WILL give it to you. At ARM USA, we choose to be a responsible gun store, and we appreciate your understanding. That's why it's called a choice. Of course, you can always CHOOSE to gun to a gun store where they'll give the test to an orangutan, but that's not being responsible, is it?

The cost for the new test is $25, which includes the state mandated fee of $15 for the certificate and $10 administration fee. For a limited time, we are offering the HSC test at a reduced price of $20 when you pay with CASH. You must print this page and bring it in when you come in for the test in order to receive the discounted rate. Hours for testing are Opening - 5PM daily. This offer may be withdrawn at any time without notice.

Our normal hours are Tuesday, 11 - 7, and Saturday 10 - 6.

Safe Handling Demonstration: (SHD) All handgun purchasers must perform a Safe Handling Demonstration prior to taking possession of the firearm. Keep your finger off the trigger and keep the muzzle poited in a safe direction - two of the basic tenets of firearms handling - are key points in the demonstration. An affidavit must be signed by the purchaser and the dealer affirming that the safe handling demonstration has been performed successfully. Any person exempt from the HSC requirement is also exempt from the SHD. If a purchaser fails to perform the SHD properly, the SHD must begin again from the beginning. We will run you through exactly how the demo must be performed. Please review the Handgun Safety Study Guide for info on the Safe Handling Demonstration prior to picking up your new firearm.

Proof of Residence: Handgun purchasers must present proof of Kommifornia residence by presenting a rental agreement, lease, or utility bill dated within the 3 months prior to purchase. Yeah, we know. Shouldn't you be able to tell residence by having a California Driver's license? You should, but what I think is really happening here is that they're going to try to shut down dealers if they're missing a utility bill copy or other trivial item. Hey - just be glad YOU'RE not the one having to keep all these books!

Thumbprint: All firearm purchasers must provide their right thumbprint on the DROS. No thumb, no gun.
Now, please don't cry about the thumbprint! After all, they already have that at the DMV. They already know everything about you. Please don't cave in and "refuse to let them have any more information!" That's exactly what they WANT you to do! If you let them win this one, then we've lost the battle. Just turn in your guns right now. Or come and give them to me, because I'M not ready to give up the fight!

These are the four main new laws that consumers must be cognizant of. But remember, the gun dealer is the one that has to keep all this krap on file for years and years. The gun store is the one that has to pay for the paper to make all these copies we have to keep. We are not reimbursed for expenses incurred like toner cartidges, thumprint inkpads, EMPLOYEE PAYROLL to pay for the extra time this B.S. is going to take to perform, or employee training and certification expenses. Keep in mind there is a myriad of other B.S. that you DON'T see, that dealers have to comply with. It's not easy selling guns in Kalifornia. That's why we need all the help you can give us, which includes buying your guns from us as well as your patient understanding in dealing with these new laws. More info will be posted here as soon as physically possible.

It's not going to be a difficult as rumor has had it to buy guns next year. There is NO 8- or 16-hour course that you have to take to buy a gun. Those were reports circulating and they are not true.

FAQS

I still have a Basic Firearm Safety Certificate (BFSC). Am I exempt from this new law?
No. The new HSC replaces the BFSC card. As of January 1, 2003, all handgun purchasers must possess a valid HSC to purchase a firearm (unless exempt).

Do I have to take a hands-on training course?
No. If you already have handgun training or experience, we can give you the test at ARM USA. If you do not possess firearms already or have some kind of hands-on experience, we recommend that you get hands-on experience with a firearm at least similar to the one you plan on buying. We have information available at the store on training courses offered by diffrent course providers.

What kind of test will it be?
The test consists of 30 multiple choice questions related to one or more of the following topics:
1- The laws applicable to carrying and handling firearms, particularly handguns.
2- The responsibilities of ownership of firearms, particularly handguns.
3- Current law as it relates to the transfer of firearms.
4- Current law as it relates to the permissible use of lethal force.
5- What constitutes safe firearm storage.
6- Issues associated with bringing a handgun into the home.
7- Prevention strategies to address issues associated with bringing firearms into the home.
Although there is no time limit, the test usually takes about 15 minutes to complete. You must achieve a minimum score of 23 correct answers.

I took a 2-day firearms course this past year. Do I still need to HSC card?
You will still need to meet the criteria necessary for issuance of the HSC card. The only way to obtain an HSC is by passing the written test. While the DOJ has stated that "the Handgun Safety Certificate Video is expected to be released in March, 2003," there is no indication that the video is an alternative to the multiple choice test as a method of obtaining the HSC. The test is the only way to get the HSC as far as I can tell.

Do I need to get the new HSC in order to keep the guns I already own?
No. The new HSC is needed only if you are purchasing or taking possession of a handgun after January 1, 2003.

Can I still use my DD214 for the honorably retired discharge exemption?
No, sorry. The state no longer recognizes Honorable Discharge (their special way of thanking you for your service to our great country). The military exemptions now include only Active, Reserve, and Honorably RETIRED.

I have a hunting license, will that work?
No, sorry again. The hunting license and hunter safety course are no longer accepted as exemptions to the HSC.

Who is exempt from the HSC?
Exempt persons include CCW holders, law enforcement, FFL holders (for curios and relics), active, reserve and honorable RETIRED military, those with P.O.S.T. 832 training certificates. Those are the most common exemptions.

So how much is this going to cost me?
The HSC costs $25. $15 for the certificate and $10 to the dealer as an administrative fee. The certificate is good for 5 years from the date it is issued (or until the legislature thinks it needs even more money from you and makes you get a new one).

What other new laws are there for 2003?
Proof of Residency - Firearm purchasers will be required to show proof of California residency. Sufficient proof would be a utility bill from within the last 3 months, a residential lease, military permanent duty station orders, or "other evidence of residency as permitted by the DOJ."

I have no utility bills or rental agreements or anything in my name - what do I do?
As of 1-3-03, I got the following answer from the DOJ:

"Dear Jolynne:

In response to your correspondence, satisfactory proof of residency
includes a utility bill from within the three months prior to the
delivery, a residential lease, a property deed, military permanent duty
station orders indicating assignment within this state, or other
evidence of residency as permitted by the Department of Justice. A
draft of regulations of proposed additional residency documentation
allowable to meet the requirement of 12071(b)(8)(C) will be available
for review shortly.

So, it looks like they are working on other methods to satisfy the residency requirment. It's just going to be a matter or time. Trust me, no one is more frustrated about this than California gun dealers.

Safe Handling Demonstration - Purchaser must perform a Safe Handling Demonstration before taking possession of a handgun. The dealer and the purchaser must sign an affidavit that the safe handling demonstration has been performed correctly and properly. Make sure you review the Handgun Safety Study Guide prior to picking up your firearm. Any mistake in the handling demonstration requires that the purchaser start the demonstration over from the beginning. Anyone who is exempt from the HSC requirement is also exempt from the Safe Handling Demonstration requirement. The safe handling demonstration DOES NOT APPLY to long guns.

Thumbprint - Purchasers taking possession of a firearm must provide their right thumbprint on the DROS. If you do not have a right thumb, you are prohibited from purchasing firearms in California. Just kidding. We will use your right big toe print instead. I crack me up!
